She went to the lobby and then maybe 5 10 minutes later she starts throwing.

And then she said something about the the people who made her come. I don't have any idea how she got here. Like she walked in from the front is all I know.

So then she finally storms out, starts walking away.

[00:18:03]Disorderly conduct requires conduct that breaches the peace, not merely offensive speech. In state versus Saunders 339 Southern 641, the Florida Supreme Court narrowed this statute against First Amendment over breath requiring actual conduct beyond words. Verbal abuse directed at law enforcement does not independently satisfy this statute.

[00:18:33]Florida statute section 800 10.09 authorizes arrest. When a person remains on property after lawful direction to leave, multiple documented warnings were issued by hospital staff and law enforcement. This is the strongest charge in the case. Florida statute section 784.07 elevates battery to a thirdderee felony when the victim is a law enforcement officer. The charge requires intentional touching or striking. Contact here occurred when the subject grabbed her discharge paperwork raising a genuine intent question. Florida courts have held that snatching an object from someone's hand can qualify, but intent must be established at trial. This is the most legally vulnerable of the four charges and presents the highest risk of dismissal. Florida Statute Section 843.02 requires only obstruction of an officer in lawful duty without violence with the underlying arrest supported by independent witness statements and documented probable cause. The resistance satisfies this statute. This charge is legally sound. The most consequential legal issue in this encounter is not among the charges filed. Florida statute section 394.463.

The subject selfidentified as mentally ill during the encounter, explicitly requested psychiatric placement rather than incarceration, and exhibited behavioral indicators of acute mental health dysregulation consistent with a documented prior crisis involving law enforcement. Florida postcrisis intervention team training mandates Baker Act assessment when these indicators are present. At least four of six statutory criteria were met. The failure to evaluate Baker Act eligibility before proceeding with criminal arrest is the single most significant legal vulnerability in this case and will likely anchor any civil rights claim. Under section 1983 of Title 42, Deputy 1 receives a B minus.

The Indian River County Sheriff's Office receives a C++ reflecting the systemic failure to apply Baker Act evaluation where statutory criteria were visibly present. Three lessons apply.
