Yeah. So, um, so basically, Fender kind of walked back on what they were saying. And let's be fair, like, okay, I'm going to throw Fender a very small bone here.

So, uh, said, "Everyone is welcome and [clears throat] will be able to continue making and selling double cutaway or two horned electric guitars as long as they are designed sufficiently different from the Fender Stratacastaster." Um, and and effective guitars would only require relatively minor design changes, which is all >> counterintuitive to the thing they said, which was like doom and gloom, death and destruction, fire and brimstone sort of thing.
>> Yes. And if I were to read that, and I did the other day, I said, "Oh, that means the Silver Sky is safe." Because I think we'd all look at the Silver Sky and say it's obviously uh a Strat inspired guitar or a straightup copy, whatever. But they have changed quite a bit.

>> About the guitar. You can't look at that and not know that that's not a different guitar than a Fender Stratacastaster.
>> Arguably more changes on a Silver Sky than pretty much anybody else.
>> Yeah. Uh I mean but it's maybe like GNL but that doesn't matter now because they own them. Yes.
>> So >> all right. So that's what we read. We thought okay now we know a little bit more. And then what happened the next day?
>> And then PRS said hey we also got a CN D. They did >> and they really declined to to make a statement but they said they are investigating it. Yes. And looking into it. But the thing that I mean we have to remember PRS has been like against the wall legally >> a couple times most significantly with the the single cut.
>> Yes, this has happened before. They had to shut down production of the single cut while they were dealing with all this and ultimately >> uh they won. And you know it's a it's interesting because I asked you this yesterday and I think this is a good question. Do you think in that fight between Gibson and PRS was the single cut more different than a less Paul than the Silver Sky is to a Stratacaster?
>> And I think absolutely yes.
>> So there is a little bit more like you know not uh legal uh you know ambiguity here but I understand a little bit more of like you know does Fender have a better shot at this than say PR than Gibson had back in the day? I think they absolutely do. Uh because to the lay person >> uh like like you know grab your like an aunt or someone and say these guitars look the same to you and they'll go yeah.
>> Uh but you know to us like we we are cursed with knowledge so of course they look different.
>> Yes.
>> But the the problem is >> with all this is is Yeah. Like the single cut >> PRS >> like Yeah. If you squint your eyes, >> that's the smoky bar argument. Always always what they said, the smoky bar argument. You go into a bar, it's smoky, it's you're >> my that that R9 is over Matthew's shoulder there. If I took the pick guard off of that, >> I don't think anybody in the guitar community, no matter how blurry I made this camera, >> would say, "Look at that PRS right there."
>> Yeah. [laughter] Well, that's also like and I and this is also something that I'm fascinated by which is the idea of like like uh copywriting the body shape >> itself versus like the entire guitar, right? The idea that you're going to see that body shape and say, "Oh, that's just copying, you know, it's exactly a Strat." But when you look at the totality of the guitar with the birds and the headstock, you nobody's gonna even close the no one's ever going to mistake that for a Fender Stratacastaster. But that's like an individual piece of the puzzle that is copyrighted versus you know other stuff which is like really really interesting you know but ultimately what I thought when I heard this was that like this to me uh to to use an old phrase of mine is the heat of the meat which is >> nom >> this actually does affect Fender's bottom line because of the the popularity of the silver sky. We see the reverb breakdown every year, but it's one of the more popular guitars sold.
>> And so, like, if they actually like going after LSL, going after any of the other small companies, >> anybody that's making cheap Chinese copies, that doesn't seem like it's going to make any money for Fender. but going after the big dog, going after John Mayer and Paul Reed Smith who are definitely selling uh a significant amount of guitars that if they can either get a license out of this or get them to shut down. I mean, I don't think they're going to get them to shut down, >> right?
>> Because [clears throat] something they'll do something else, but you know, I mean, thinking about like what the Silver Sky has done for PRS and thinking about that sliding door scenario where they keep John >> Mhm. And none of this ever, you know, happens. I mean, it's like not to say that PRS would be um uh out of business or anything, but it's was it's a huge factor in their growth over the last 10 years. Oh, >> absolutely. Is the is the diversification of their lineup and then also bringing all these new people in that had never been uh into a PRS before.
>> 100%.
>> Yeah.
>> Yeah. So, [clears throat] um the Silver Sky, like if we want to dive into that really quick.
>> Yeah.
>> Uh launched 2018.
>> Uhu. uh mayor left Fender in 2014, which is crazy. It was that long ago.
>> Wow.
>> Like like when you think about it, you're like, "Oh, yeah." But like it just seems like a few years ago in 2018.
Wow.
>> Um >> and then so on reverb, you know, their bestseller list, which is like >> who knows what math they're using, >> right? And like how many guitars were bought and sold and bought and sold and bought and sold on reverb like a single unit. Like it doesn't account for that.
It's just like units sold. It's a, you know, it's an aggregate just on one platform. But, >> um, the Silver Sky was their number one electric guitar for 2022 and 23 and then it fell to number three in 24 and then rose back to number two in 25.
>> Yeah.
>> So, like that is the the ultimate thing that's that's ticking off Fender. Um, but >> I think the bigger question is is if >> PRS if they can't defend this >> Yeah. then no one else >> I think >> has a chance.
>> Yeah, I think they'll be fine.
>> I think they will too because apparently uh one lawyer who has beat Fender before >> is uh >> excuse me, >> he released a statement and he may be involved with some of this because he represents sir ESP Shre and other makers. It's a uh Ron Bintock.
Uh, so you know, [sighs] I don't know. I I find all of this to be well, >> really just sad.
>> I think here's uh CBST. Love the statement post single cut lawsuit. We'll put it up. Um, the court found no likelihood of confusion between the two guitars, noting that only an idiot [laughter] would be able to tell part of the point of sale. That's like legit funny.
And I think that like ultimately that's what we're discussing here is that I don't think there's a soul alive who's accidentally gonna buy a silver sky thinking they're buying a Fender. So again, it's sort of up to for Fender to sort of, you know, prove like what kind of damages they they're getting besides John Mayer hurt our feelings because he would rather talk to Paul Reed Smith and than the dude with the ponytail.
[laughter] >> And that's kind of what we're talking about, you know.
>> Yeah. Yeah. It's it's a very man like >> John going to PRS is the greatest thing that ever happened to PRS I think.
>> Um and I just I don't see a world I mean because like we okay we're talking about here is like they're not going after >> the trademark. Correct. They're going after the copyright.
>> The copyright's more artistic like versus the you know because the headstock is trademarked.
>> Yes.
>> And that's something that they've had and enforced and for years. she can't do the head stop, >> right?
>> And that's sort of been like as far as like we know it as guitar players like yes, thumbs down. Sorry, mom. I'll I'll do better. I'll call I'll call. Um I think that like the idea is that like we've sort of accepted that for so long, >> right?
>> That like the body shape and the general idea, >> but as long as you have a different headstock, then we can tell the guitars apart and we're cool, right? We've all kind of said like we're good, right?
everybody kind of gets it and that doesn't mean that Fender and Gibson love it, right? And and are okay with it, but we've sort of like kind of settled in on that. I think that's ultimately like when we're talking about uh public perception or law or whatever, it's sort of like this has been the norm for so long, it seems really difficult for uh like that to uh either legal precedent or public perception to go away >> because that's how we've been operating for the last I don't know how many years, >> right?
>> You know what I Yeah.
>> And and I did ask you this and I think this is a funny thing and I'll ask you this question and I think this is sort of uh if you like pick a brand a newer brand that has a unique body shape.
>> Okay.
>> Go bomb or bomb.
>> They are a new company with a unique body shape. Yes. Right. If somebody came out tomorrow with that exact body shape.
>> Yeah.
>> Right. The community would be up in arms and hate it and burn them to the ground.
>> Yeah.
>> Right.
So, what is the difference there? I'm just I'm just we're just talking here.
We're just talking. What's the difference there? Why is that Why would the community and everyone be like, "No, you can't do that." Is that just the the guitar playing community like policing itself?
>> Yeah.
>> Saying you can't do that, but this cat's out of the bag with the Stratacaster, so it's okay. That's kind of how I feel about it. But I just I like to ask that question.
>> No, I think it I mean like yeah when when the cat is out of the bag but we do see it like you know we've uh we've talked about this before and you've seen it before.
>> I know I know exactly where >> Yes. So that was sort of I wanted you to go there but you went with bow.
>> Well I mean you're talking about you really unique and weird.
>> Yeah. Yeah. Yeah. Obviously I was I was uh GM of Novo for six years. I was the first uh um employee hired there. And anytime anybody like, you know, got close to that body shape, and there's been several brands that have come out with something that was clearly like cribbed um from that. I mean, Iconic came out with a guitar that was clearly a mirrorist.
>> There was another one too that was like >> and you know, but you know, it's uh it's a little bit like you know, you know, you if you don't have the the legal part of it down, right? you haven't trademarked anything, you haven't copyright anything because it's really expensive. It's like that's sort of like, you know, the community has to do the policing >> where they say, "We're not buying this.
We don't like it. You're just copying this. This sucks." Right. Yeah. And the community has spoken that they want Strat copies.
>> Yeah.
>> They want teley copies.
>> Yeah. Absolutely.
>> And they want less Paul copies and they're good to go. And that's a little bit like not saying that law doesn't have anything to do with it, but you know, it's a little bit like the the the silver sky is a runaway success because the people wanted it.
>> Yeah. And and well, and let's face it, it's a really good guitar.
>> That's what I mean.
>> You know, like there's no denying when you play an SE, you're like, "Wow, this is how much and it is this nice." and then you play a USA Silver Sky and it's just like it kind of blows away anything the same [clears throat] price bracket.
>> The price of the USA Silver Sky is excellent.
>> Yeah. For for what you're getting. Um it's it's interesting though because we've talked about this a few times on on Dipped.
>> And uh you know, we talked about how if people make the argument like if if these other brands want to [clears throat] survive, they need to innovate and make new shapes. And we said, you know, people don't want that.
We've talked about this and like people clap back saying, "Well, what about Reverend? What about all these other companies?" I'm like, I'm not saying that there's no room for new shapes or innovation or new design, but in the grand scheme of things, >> Yeah. Yeah.
>> what is desired by players are the things that were played by the heroes on the posters that we hung on our wall.
And let's face it, you know, a double agent reverend >> doesn't have the same effect as a white stratacastaster or a a a blonde, [clears throat] you know, >> also because broader popular culture rock and roll has been in stasis for the last 20 years. Yeah.
>> And that's part of the the issue is that we're still we're still there because, you know, we've kind of we've stopped >> like Ripley >> basically. Yeah. Yeah. Yeah.

Um, sorry I just joined, but you touched if you touched on this, but a USA Silver Sky is just the Silver Sky. That's the only model, whereas Fender has about 10 different USA strats. That's confusing itself. I remember the day where that hit me, you know, and I've talked about this on the show and I'll talk about it again because good point is someone literally asked me that question. They never played one. They came in um to look at uh you know, lots of different guitars like what's the deal with the Silver Sky? It's like immediately I was like that's really what it is is that like the the the the ease of like I've decided I want this and I know that there's two options and I pick a color and a fretboard is so nice and you know there's no confusion on why I would spend $1,000 or $1,500 or 2,000 or $2,500 or $3,000 on a guitar. Like what are the differences? What makes them what? What does this one have that this doesn't have? It's just PRS is like, "We're going to make the best one we can in Indonesia. We're going to make the best one we can in Maryland and then you buy it." That's like incredible. It's all I've ever wanted from any company.
It's all I've ever tried to do at all the companies that I've worked for is make it that clear >> for the customer to understand what their value is and what they're getting.
And to me, that is so nice. It's so huge. And now as selling them, that's that's what I love. Makes it so easy.

M >> um I do think there's obviously something and you know red has talked about this, we've talked about this on dipped where you know >> the cost of living and inflation has has taken its toll on everything but you know >> it's taking a toll on you. A lot of it is that like yeah like everything starts to cost more, woods costs more and you know production costs more and everything starts to go up and then also you see all the other stuff start going up and you're like okay we're going to raise our prices too >> and the thing that's the slowest to go up is uh regular wages for regular people, >> right?
>> And like that's the uh >> that's always really difficult. You know, you can look at like how much money, you know, I mean how much money you were making 25 years ago versus how much you're ma money you're making now.
then the price of the guitar is way higher >> than that percentage. I think it's everybody knows that and like >> even 10 years ago.
>> Yeah. And that's that's really difficult. And I always think it's fun because uh the pedal game >> Yeah.
>> doesn't go up >> pretty much pretty much the same.
>> Yeah. Tube screamer is still, you know, same price.
>> I mean the tube screamer is a little more expensive than it used to be.
>> Yeah. But we can't raise prices like other brands do. Like like Okay. So like >> well in a way so I mean I do think we'll come back to touching on this. I do think in the guitar pedal space >> the willingness to pay >> more for uh >> throughhole components >> for a more um >> boutique quote unquote uh production. It is there and I think there is room for that. I think people are willing to to splurge a little bit for that. Yeah.
>> Um but for your bread and butter pedals, >> uh yeah, there's the like if we said tomorrow, hey, Mjolnir is going to be $2.99, they would burn us alive.
>> Yes, [laughter] we can't do that. And looking at the percentages too, it's like maybe not even like I know how much a Sarah J cost, you know, in 2016 because I was running the company and I know how much it costs now and it's significantly more. Yeah, that was 10 years ago and a lot of things have changed since then. But if we took the percentage price increase of that and said, "Let's apply that to Mujir, we couldn't do it."
>> No.
>> And you know, I think probably it's because with instruments, people understand the craftsmanship that goes into it and are willing to pay for that versus pedals, which I get that. It's just an interesting component to this, you know what I mean? Versus versus anything else. So, >> yeah. But but the willingness for people to buy counterfeits, I don't think that it's so much people's willingness to buy them. It's just it's never been more easy to get a counterfeit with Alibaba and AliExpress, Timu, and all this stuff. Like, it's so easy to get this, >> let's face it, junk.
>> Um, >> and that people are willing to do it because a lot of people see it as a name on a headstock and they don't care about anything else. Uh, they don't care that it's a piece of crap guitar. They don't care that it might not have a trust rod or have a trust rod that works or it's made of >> just, you know, made of cardboard and, you know, and glue.
>> Uh, like that sort of idea. People don't care about that. Um, but I think the reason that a lot of people are caring less and less about those things is because the costs have gone up and it means less to people. Well, I think that's also why people really, you know, get into, you know, modding Squires and and want those guitars to be good and and it'll spend the time and the effort and the money to get there because they think price-wise if I can get, you know, spend a little extra money, I'm still going to be under like a player two, right?
>> And I can get get kind of what I want. I mean, that that feels like, you know, you know, more of the trend. It seems like >> uh you know that that and that's probably what Fender is banking on by having so many SKUs.
>> Yeah. in so many different price points is saying like, "Well, we'll still get this for the people that want to spend the money, but like people that are put off by that, here's all of these other options." It's just it's just ridiculous.

Um, and then it went away for a little while and now it's back. So, I'm a big fan of the chop telly bridge on stuff. I think getting that little extra bite, little brass saddles.

>> On with different pickups is a very cool thing. So, >> this one has like a real >> It has a really nice resonance to it.
It's very lively.
>> Um, and like There's something about I don't know like all Novo necks are great, right?
There's no denying that.

And having that clean like nickel or chrome cover looks really good, but it's not the tone that anybody's really going for [clears throat] when they're getting it.
If it is, then it can work great. It's just we have to kind of talk through it because it was just people were ordering it and they wanted the guitar to be mean and it's not going to be mean. It's not me. Firebird bridge pickup is >> like like really uh bright. Oh, I like this guy. Your band choices are also butt ugly. Cool. Watch this. >> These are the frail and pure PAF.
>> Oh, they sound great.
>> Um, bright and harsh. Uh, yeah, the bridge Firebird bridges is just thin and crappy.

>> They sound right.

>> I mean, you can make them sound okay, but it's like you shouldn't have to make things sound right. They should just be right. I'm, you know, it's it's people buy what they want to buy. It's just like I think that like it's hard sometimes, you know, always when we're doing this, it's important to uh act ask like what are you actually going for here? You know, and that was really my point is that like when people would say like what the guitar they wanted to sound like, I would never recommend the Firebird Bridge because no one's ever saying that that's what they want out of the bridge. Uh, >> is that it everybody?
>> I need to build a plasma rifle and and a Robocop gun with my proton pack. I want to I want a blade rob.
>> I mean, there is like another life where you just [music] a propmaster, you know?
>> Love that.
>> You guys buy enough pedals and then that's what he's going to end up doing.

>> Yeah, it does. Novos are the loudest uh solid body electric guitars uh acoustically that you can get. I've never heard anything as loud.

>> Done Smith downstate. I played a Firebird at my local shop recently and it was my first experience of that guitar. I rather like the sound of the bridge. What am I missing?

>> It's the totality of the build, too.
We're talking about like being at Novo with pine body bolt-on maple neck uh mastery bruisen trim. It's like the Firebird pickup in a in an actual Firebird with the the whatever woods and bridges. It's like it's a completely different thing. Also could be made and wound differently than the way they're made now. You know what I mean? There you go.

You know, like >> I I think sometimes Gibsons have honestly have a little bit better shot because sometimes on a standard production guitar >> Yeah. uh the the pots are not as high resistance, so they're inherently a little darker. So, you have a pickup that's really bright and you put in a dark >> pot and it's shaving off a lot of those frequencies. And so, it's like doing the guitar a service. Like, it's not always best to have like the best, highest resistance, best tolerance pot. You have to put what's best in your guitar. And when you have like really good pots like in this where there's a lot of clarity and you put a bright pickup in it, it's just like >> So, >> oh, people were asking why don't we plug in and play it?
>> Because I don't have any.
>> We just didn't we just we just forgot to.
>> We were kind of get down to the wire today.
>> We have to like, you know, make that decision before the stream that we're going to do that. So, yeah. Yeah. Yeah.
