Manion's lawyers were trying to get all the evidence that was found in Manion's backpack thrown out, saying the search was illegal. The judge said some can come in, including the alleged murder weapon and a red notebook of Manion's writings that included his frustrations with the health insurance industry. The judge said that could come in because the search was legal pursuant to the Altuna Police Department's inventory protocols. But the judge said other evidence is out. That includes his cell phone. It includes uh his passport and it includes a magazine of ammunition. The judge said that can't come in because that backpack was searched illegally. There was no warrant and there was no risk to the public. So the judge throwing that out.
