[00:01:07]Then I have a probation violation hearing at 9:30 how long our first hearing will take place.

[00:01:15]Then I have a PO hearing which we don't live stream those and then we have final pre-trials this afternoon. So fairly full day I haven't been meeting that much. Yesterday's song of the day our shared moment of humanity was a song that you didn't recognize from the word but everybody knew the song and to forget how good Whitney Houston was.

[00:06:58]Title of the case is the village of White Pigeon versus Ryan David Rosanski.

[00:07:15]For reasons I don't completely understand, the civil infraction cases have a real long number.

[00:07:21]Fennon got a ticket on April 4th, 2026 at 9:00 at night in Way Pigeon at Vermont and Elcart Street. The terrific the ticket was written by Sergeant Hansen, who is present here today, Matthew Hansen.

[00:07:41]Uh he was cited with disobeying a traffic control device. Uh, that is a civil infraction in violation of 257.611.

[00:07:54]It carries a fine and two points.

[00:10:14]>> Okay. And um what is your I guess let me ask you this. On um April 4th, 2026, were you in that role?

[00:10:22]>> Yes, sir.

[00:10:23]>> What are some of your responsibilities in that role?

[00:10:26]>> Uh patrol the village uh responding to calls, traffic enforcement.

[00:10:31]>> Okay. And were you patrolling on April 4th? Yes, sir.

[00:10:36]>> Um, was that in the morning? In the evening?

[00:10:40]>> Uh, in the evening.

[00:10:41]>> In the evening. Were you on patrol around 9:00 p.m.?

[00:10:45]>> Yes, sir.

[00:10:46]>> And, uh, where were you patrolling at that time?

[00:10:49]>> Uh, I was conducting directed patrol along West Vermont Street near Elcart Street due to, uh, some recent reports of traffic issues at the stop signs from the apartment complex.

[00:11:01]>> Uh, what kind of traffic issues? Uh we've had uh numerous complaints from the residents that the new apartment complex was failing to stop the stop signs and failing to stop the the apartment complex.

[00:11:13]>> Okay.

[00:11:14]So a directive patrol, and correct me if I'm wrong, is basically you're you're looking for obviously you would stop any crime you see, but you're looking for a specific kind of crime. Is that fair to say?

[00:11:24]>> Yes, sir.

[00:11:25]>> Okay. Um and on that day on April 4th around 900 PM, did you see uh let me ask you this. What did you observe >> uh around that time? I did observe a white Toyota passenger car uh came up Bradley Street to West Vermont Street.

[00:11:42]It was going a little fast, just a couple miles over the speed limit. Not a big deal. Uh I did watch the vehicle go into the cemetery after hours. A little unusual. Um I believe it was someone from the vehicle went to the apartment complex.

[00:11:57]Uh they were there for a few minutes and then they left. Uh upon leaving the cemetery, the white passenger car failed to stop leaving the private drive and then turned and continued east westbound on Vermont Street, failing to stop the stop sign at Vermont and Alcar Street.

[00:12:19]>> Okay. And um these this this intersection that you mentioned, is that in the village of White Pigeon?

[00:12:25]>> It is.

[00:12:25]>> Is that in St. Joseph County? Yes, sir.

[00:12:27]>> State of Michigan?

[00:12:28]>> Yes, sir.

[00:12:28]>> Perfect. Okay. So, after you saw this vehicle pass the stop sign without stopping, what did you do?

[00:12:35]>> I conducted a traffic stop.

[00:12:37]>> Okay. Um, tell me how that went.

[00:12:42]>> Uh, I identified the driver as Mr. Rosansky, if I >> Yeah.

[00:12:47]Uh, he was the driver of the vehicle.

[00:12:49]Um, after my contact with him, I did decide to write him a citation for disobeying the traffic control device.

[00:12:56]>> Okay. And you already kind of have done this, but is is is Mr. Rosanski in the courtroom today?

[00:13:00]>> Yes.

[00:13:00]>> Could you identify him uh in an article of clothing he's wearing?

[00:13:04]>> He's sitting here with a white shirt.

[00:13:55]>> Mr. Rosanski, you've been through an informal hearing and I wasn't a part of that, so I don't know anything that happened there. But as in that case, you have an opportunity to question uh this witness if you wish to. Are there any questions you wish to ask of officer Hansen?

[00:14:11]>> Yes. Um actually um yeah, there's several questions. Um for uh just just as um Mr. Mr. And can you uh clarify where exactly you were positioned at the time that you observed the alleged traffic violation?

[00:14:27]>> About a block east.

[00:14:30]>> Um for the record, could you name that intersection?

[00:14:34]>> Uh it' be St. Joseph Street in West Vermont.

[00:14:36]>> Okay. Um and we acknowledge that this was at nighttime. Um where where is the traffic you're familiar with? Where exactly is that stop sign and where is it pointed? The stop sign would be at the intersection facing east.

[00:14:53]>> Would be at the intersection facing east. And how when would when when the geometry of said intersection is put into question where is the exit of the private drive in relation to the stop sign?

[00:15:07]>> It would be before the intersection.

[00:15:11]>> Um I don't know. Can I is it do I have the ability to submit photo evidence because I don't I wasn't able to do that. How do how do I do that?

[00:15:21]>> Photo evidence of where the stop sign is.

[00:15:23]>> Okay. What what nature is the photograph on your phone?

[00:15:27]>> Yeah.

[00:15:28]>> Um there is a way to do it, but uh I may just have to look at your phone.

[00:15:40]>> Okay. I got this is an informal hearing. I mean, excuse me, a formal hearing, but it's a civil infraction.

[00:15:51]So, the burden of proof is only a prepoundonderance of the evidence and uh there's no right to counsel or no right to a jury trial in a civil infraction.

[00:16:02]So, Mr. Rosanski's been through this hearing once in the informal hearing before the magistrate. the law allows either party to appeal that and that's what this defendant has done. So, it is a little less formal than a regular trial. Uh, so I guess what we'll just do is look at his phone.

[00:17:41]Sergeant Hansen, what's the name of the new apartment complex that's gone in there?

[00:18:07]The first picture is would be um a a perfect snapshot of what of where the stop sign is located from the perspective at which I was approaching um the intersection. And then the second is would be from his view.

[00:18:24]>> All right. What street is the car on from which the photograph was taken?

[00:18:31]>> On which picture? One or two?

[00:18:33]>> I'm only looking at one >> on one. That is the exit from that's exiting the cemetery.

[00:18:38]>> You can clearly see that the stop sign is not facing that the graveyard.

[00:18:41]>> All right. So, you're going from the cemetery >> onto the other intersection, which from his view would be the second photo.

[00:18:53]You can clearly see that the stop sign is not facing the cemetery. And and when the if you turn into the intersection as once you arrive onto that intersection, your car is already past the stop sign and there is no stop ahead sign anywhere to be found.

[00:19:16]Uh the cemetery is a private drive. Yes.

[00:19:19]>> He indicated that you didn't stop when you pulled out of there entering onto the main roadway, but there is no stop sign facing that direction.

[00:19:31]>> Exactly.

[00:19:31]>> When you get onto the roadway, uh there is a stop sign which appears to be about 8 ft from the intersection.

[00:19:41]And uh all right, you've seen it, but you can look at it.

[00:19:50]Um the second photo um you would the second photo is would be from his view not from my view pulling out.

[00:23:36]>> You were coming this way. There's no stop sign from the cemetery onto Vermont Street. Is that correct?

[00:23:43]>> Yes.

[00:23:44]>> And then you were going to turn right down this road to go towards the apartment complex.

[00:23:50]>> Yep.

[00:23:51]>> Now, this is an old Google Earth photo, but uh it shows a temporary stop sign.

[00:23:59]So, the stop sign in your picture would be >> some somewhere >> right about there. All right. So it's your contention that >> my contingent is that under >> that you came out of here and the stop sign didn't tell you to stop there and then by the time you got here the stop sign was already >> has already passed. So it under under normal nighttime driving conditions it would it is not visible enough to give a adequate adequate time to respond to the sign. Therefore the a stop ahead sign would be required. However I don't think that would be necessary because Michigan law says that um you have to stop at all private drives which I'm from Indiana and that's not the case there.

[00:24:51]The requirement in Indiana is to yield unless you're turning left.

[00:24:56]Right, I'll stop sharing. Anybody else want to comment on any of this? The picture is not the greatest, but it does give a better picture that we can all see of this intersection. Looks like it was takes on a nice summer day, but at the time this was taken, that complex was not there yet.

[00:26:28]>> Um at at this night, um I noticed I'm I'm unfamiliar with the area. I'm not from here. I'm from India. Um I was I was door dashing with my girlfriend and we were doing our last little delivery for the night. I'm being unfamiliar. Say that again.

[00:26:43]>> You did a word I didn't hear. something delivery.

[00:26:45]>> Yeah. Yeah. Door dash.

[00:26:46]>> I know. But you said you were doing a rrestling delivery or something. I didn't understand what >> Oh, no. I We were me and my girlfriend were door dashing and it was our last order for the night we were doing.

[00:26:55]>> All right. You were door dashing. That was your last delivery in white pigeon.

[00:26:58]Yep.

[00:26:58]>> Where were you delivering from?

[00:27:00]>> Um Oh, I I I don't remember off the top of my head. I do I do hundreds of deliveries.

[00:27:06]>> All right. Why did you end up in the cemetery? Um, I was unfamiliar with the area and um, it's I went where the GPS told me to go. Um, you know, we deliver in strange spots all the time, so it wasn't necessarily unordinary to deliver to a cemetery, especially if there was like a security guard we were delivering to or whatever the case may be. But when I got up to the pinpoint, I was like, "Oh, it's an apartment." You know, and that's not I don't I don't see that being that big of an issue, especially because I'm already in the cemetery. So, I delivered my order. I turned around and I got back in my car. I got everything ready and then I I drove forward. I did a U-turn and then I exited. As I exited, I hit that I I I looked to my left quick. Remember, I'm notic I made a statement saying I was from Indiana. Our only requirement in Indiana when turning right out of a private drive is to yield. So, I looked to my left. I didn't see anybody. And so I went on I turned right and I went on.

[00:28:05]Um and then as I was driving um he initiated a traffic stop against me and I and I and I stopped. Um during the um during the traffic stop he uh gave he questioned me um in regards to several matters but um he questioned heavily as to why I was in his main focus was why I was in the cemetery. Um, I answered accordingly and then he meant he asked if I saw the stop sign back there. I said no. I had no idea there was a stop sign back there.

[00:28:36]And um, after that he uh, wrote me a ticket saying that yeah, you stop sign even though I had no knowledge of a stop sign back there. Um, and that's when I went back and took pictures cuz I was like, is there really a stop sign back there? And so I went back and that confirmed obviously there's a stop sign back there.

[00:28:56]>> All right. Um, I didn't understand the sequence.

[00:29:04]I assumed that you were I I don't know. I assume maybe you went in the cemetery for a minute, then came out of the cemetery and were on the way to the delivery.

[00:29:16]>> No, >> but your statement is you'd already made the delivery.

[00:29:19]>> Yes. I Yes. I Yes. The the delivery was inside of the apartment complex, but it was a building that was right next to the cemetery.

[00:29:28]>> All right. Then you went back into the cemeter.

[00:29:30]>> No, no, no, no, no, no. I was in the cemetery, then I made the delivery because you just you just walk right across.

[00:29:36]>> All right. So, you stayed in the cemetery and made the delivery.

[00:29:40]>> Yes.

[00:29:41]>> All right. So, you left your car in the cemetery, walked across the grass or something, >> made delivery, got back in your car.

[00:29:49]>> Yes.

[00:29:50]All right. And you were coming back to your car and then you were going to make a right turn.

[00:29:56]>> No. And then I made a U-turn and then I made that right turn onto Vermont Street.

[00:30:01]>> Okay.

[00:30:01]>> All right. Which would have taken you back toward the apartment complex.

[00:30:07]>> Yes.

[00:30:10]>> Where you did the U-turn inside the cemetery?

[00:30:12]>> Yes, I did U-turn inside the cemetery.

[00:30:13]>> Okay.

[00:30:15]Um, and then that for Monster Street would eventually get you back to US12 or whatever way you were going to use to go back to Elk.

[00:30:25]>> Yes.

[00:30:28]>> All right. Does that raise any questions for you, Mr. Buck?

[00:30:31]>> No, your honor.

[00:30:40]>> Thank you, your honor. I I honestly have no doubt that Mr. Rosansi didn't see the stop sign. Um I think that that's fair to say. He did however go through the stop sign without stopping. We heard uh Sergeant Hansen's testimony to the same.

[00:30:55]He observed uh Mr. Zanski coming out of the private drive, turning right, passing the stop sign, and continuing on without without stopping. Um it's obviously that's a disobeying a traffic uh control device. I think I think it's pretty straightforward from there. I don't think that there has been any evidence that the um traffic signal was improperly placed. Um you I I don't think that it would be appropriate, in fact, it isn't appropriate to put a stop ahead sign on a private property, in this case the cemetery, to let you know that there's a stop sign around the corner. Um while these sort of I guess intersections aren't incredibly common, this is This is not an unforeseen thing. Um the this where you have an immediate turn and a stop sign uh right after. Um I think it was an honest mistake, but he did violate the the Michigan law and uh I think that the uh the villages met its uh its burden.

[00:32:02]>> Can I counter?

[00:32:03]>> Yes, you have. Um the manual on uniform traffic control devices is clear in its in its um uh its um conditions that um all signs must meet. Um it is clear that a stop sign must be facing the lane it intends to control and give notice. If it does not give notice, a stop ahead sign must be placed. However, we've made note that the that failure to stop at a private drive is is the what is that's what I I failed to stop at a private drive. Um, so that that would satisfy the stopping requirement. Um, I do not I I would say that the stop sign is improperly placed. I believe that it should be placed before the the um the uh the intersection because at the when you were exiting the cemetery, all lanes of travel affecting the driver leaving the cemetery are visible from the cemetery.

[00:33:00]>> All right. You raised an interesting defense. Here's the intersection again.

[00:33:08]Uh this is a recipe for an accident. If we use your theory, uh there isn't anywhere else to put the stop sign. The stop sign is to stop uh >> east westbound travel.

[00:33:28]>> Yes. and I was not heading west.

[00:33:31]>> And uh they can't put a stop sign ahead.

[00:33:39]One thing that would perhaps help if they put a stop sign at the end of the driveway.

[00:33:44]>> That Yeah, that would be that would be property.

[00:33:46]>> But that's private property. It's not state road.

[00:33:51]So the stop sign is to This runs north and south or east and west. Uh Vermont is east and west.

[00:33:59]>> All right.

[00:34:00]>> So it's to stop people going down Vermont Street from pulling or colliding with somebody coming off the north south intersection. So there's a stop sign right there.

[00:34:14]But if everybody was able to do what you did, it would circumvent the whole thing. If he were able to just pull out of here without stopping and then go here without stopping, it would be a recipe for a collision in this intersection.

[00:34:35]Now, granted, it's at night. You're not familiar with the area, but if it didn't apply, it would be a way to just simply circumvent that stop sign. Um, >> that's where you would have the failure to uh stop at a private drive.

[00:35:08]Let's talk for a minute. The traffic control device, this little temporary sign here is not what was there. There was a fully posted state highway uh correct stop sign that you showed me in your picture. It was a a rural area and they built an apartment complex. It probably has 50 or so uh units in it. [00:37:07]Um so you have an argument that coming where you were you wouldn't have known of the stop sign but you clearly failed to stop exiting a public driveway which I think is going to be the same thing a private driveway.
