The U.S. Congress has the constitutional authority to expand the Supreme Court's size, as the Court's composition is determined by legislative action rather than being fixed by constitutional mandate; therefore, if expanding the Court from 9 to 13 justices is considered the right policy, Congress should exercise this authority immediately rather than waiting for a different administration.

Jim Jordan Calls Democrats' Bluff on Court Packing: How About We Do It Now?Added:
The chair recognizes the chairman of the full committee.
>> one question. I'm just curious what what the panel thinks. Um Why why don't we just add four justices now?
13 circuits, we need to go to 9 to 13 as the ranking member of the full committee suggested at the start of the hearing.
What what why wouldn't we just add them now if we're going to add them? What do you think of that? Uh we'll just go maybe go down the line. The first rule of justice is what's good for the goose is good for the gander. Uh I oppose doing that now just as I would oppose doing it under a different president.
>> that's where I'm at.
Totally agree.
Uh [clears throat] but it seems to me if we're going to do it and 13 is some some important number that we got to get to based on the number of circuits, then uh we should if we're going to do four, do it now. Mr. Buoy, would you support doing that? Doing four?
You said if Congress thinks it's the right thing to do, we should we should go for it. So if it's the right thing to do, can we go for it now? Well, I agree with the principle. It's in your prerogative You have the prerogative to determine how the Supreme Court works.
The court did not descend from on high in its current form in the palace across the street. It's your job to determine what kind of court >> have no problem with us doing it now?
Look, I disagree with many of the policies that come out of Congress right now, but I really have faith in your ability to live up to your office, and I think that you have the authority to determine what kind of justice we want to see in this country.
>> That's great. I think I know what Professor Ross and Mr. Sherer's answer is as well, which is where I'm at, but You know, I I would oppose any expansion of the court. Yeah, I'm I'm there, too.
