Did you ever wonder to yourself, why is the New Jersey magazine restriction limit 10 rounds? Why isn't it 12? Why isn't it 13, 14? How did we get here? I don't even know. But we're going to try and figure it out. And we're going to talk about that today. But before we do, hit that like and subscribe button.

You're trying to figure it out. We're all trying to figure this out. Well, the first reason we're here is because of the Assault Firearms Act in 1990 signed by Jim Florio. That was the first time that we had any type of magazine restriction at all. Apparently, it would went to 15. So, anything over 15 was considered large capacity magazine. So, before that, before 1990, there was no actual magazine restriction. That wasn't that long ago, which is very interesting. So, if 10 rounds is the perfect number for today, why wasn't it the perfect number when they allowed 15?
And if 15 wasn't safe enough, what stops them from saying that 10 isn't safe enough? And Virginia only restricted theirs to 15. Different states have different numbers. So, who is figuring out and how are they figuring out what number is the safest and what number it should be restricted to? So, New Jersey didn't restrict magazines to 10 rounds until 2018. So from 1990 to 2018 you could have 15 round magazines and that was completely legal. So in 2018 that's when they changed it. So what changed?
What changed from 1990 when they restricted it to 15 then to 2018 that made it all of a sudden too dangerous for people to have five more rounds in their magazine? That five round difference really was that much of a problem that they had to now restrict it. So let's think about this for a second. Is there some type of scientific number that they come up with? Some type of calculation? Maybe they took some statistics and evidence and put it all together and made some type of calculation that says that criminals stop committing crimes if their magazines hold fewer rounds. I I don't know. New Jersey says 10, Colorado says 15, Virginia says 15, and other states have no limit at all. This is science.
Why does every state have a different answer? I'll tell you why. Because the numbers appear to be political choices rather than scientific calculations. No one can predict how many rounds you're going to need to defend yourself in a self-defense situation. Self-defense incidents are unpredictable. You never know how many attackers there's going to be. People obviously miss under stress.
It could be in a low light situation.
And criminals don't follow magazine restrictions. So, they would have an advantage over you if you only had the 10 round magazine and they didn't follow the magazine law because they're a criminal and they had 30 rounds or 15 rounds or whatever rounds their magazine held. How can any person know in advance how many rounds another person's going to need to defend themselves in any situation? Because you can't tell the future. So now, let's listen to a clip of Attorney General Jennifer Davenport.
She's being questioned by an Assemblyman in New Jersey and he asks her why she thinks crime rates are going down and he says some people are alluding to the fact that now brewin was passed so we can carry more firearms. And her reason for the drop of crime is well, you'll see. You mentioned early in your remarks that there has been a a decrease in gun crime in New Jersey and that it did not happen by accident. It strikes me that the most consequential change to gun policy in the United States over the last 5, even 10 years was the Brewan decision on right to carry, which many New Jerseyians are availing themselves of that opportunity. What role do you think that the Brewan decision played in the decreasing gun crime?
So, I think that as we talked about here, I think the the decrease in gun crime is is for a there's many different parts of this. um the effort and enforcement that our um that our law enforcement officers have put into this with respect to um the criminal act work, the gun violence reduction task force, that's us and federal law enforcement in all 21 counties, state police, DCJ, um you know, and also the laws that we have in our state that have been upheld that whether it's lower capacity magazines means, you know, hollowpoint bullets or or all the different laws that we have and the civil litigation that we've taken in those ways to make sure that they're upheld from gun and manufacturers who are coming into our state selling things that they should not as well as the work that we've done with ghost guns and and 3D printing and things. So, all of those things.
>> Yeah. So, her number one reason is what I agree with. Yes. Police. But remember, police are there after the fact, after the crime already happens. Then her other reason is because of laws like the 10 round magazine restriction. So please, Mrs. Davenport, tell me, how does a law that restricts magazine limits that criminals aren't going to follow anyway make there be less crime?
Maybe even if the criminal did follow the law, maybe if that criminal only had 10 round magazines, is he going to now think to himself, "Man, I've only got 10 rounds instead of 15, so I can't commit this crime today because my magazine is restricted." Of course not. He doesn't care. He's still going to commit whatever crime he wants. He still has a gun. Criminals already ignore robbery laws, assault laws, murder laws, so why would they follow magazine restriction laws? Comment down below. Let me know.
Do you think that this magazine restriction changes criminal behavior at all? Do you think they even care? New Jersey has already seen the limit reduced twice, not just once. And other states are adopting their own restrictions now. So, do you think they could try and lower it again? What's going to stop them? But the good news is because we have things like the Brewan case, which says it has to be historical president for these laws, hopefully these things like this will be fought in court and eventually won one day. I like to look on the bright side and think that someday we'll get there because like I always say, we never thought we'd be able to carry in New Jersey and now we can. So give it some time.
