Impeachment! Concourt Rules Ramaphosa Must Answer for Phala PhalaAdded:
Ladies and gentlemen, we have breaking news. Firstly, quick apology. I am still sick. So, if I'm a bit all over the place, please forgive me. I am heavily drugged at this point. This flu has not been fun. But more importantly, we have breaking news. The Concord or the Constitutional Court of South Africa just made their ruling on Sora and the impeachment hearings in Parliament.
Before we get to that, let's do a quick refresher and I'm going to go as quickly as possible for the international viewers. The Pala Pala scandal as it became known in South Africa is from a robbery or a burglary that happened in 2020 on a farm known as Pala Pala that is owned by the president Ben Sil Ramapa although he's president still now. The burglary involved $580,000 in cash that was stolen from the farm.
In subsequent years, we would find out that Sir Raaposa was trying to keep this burglary off the radar of the official police records by sending his own secret service to actually do the investigation, using people offline so that no one would actually know about it. Eventually, it did come to light and this came with a number of questions.
For example, why does the president of South Africa have $580,000 US mcking about on a farm out in Limpopo? More importantly, why was this money never declared to the South African Revenue Service? Why was this money never declared to the South African Reserve Bank? Both of these are legally required especially for that amount of money. Then we had the Mlanga Commission and at the Mlunga Commission we heard people like Vousy Cat Mlala say that he personally drove couches full of cash to Palipala because Palipala was sort of the central staging ground. From there the ANC would send out hitmen. the ANC or Soraposa or people connected to Suraposa would have all sorts of underground and criminal activities being funded by the money going to and from Palapala. The president maintained that this money may have been for the sale of some buffalo or perhaps a cow of some kind. In fact, the president most often chose to go with his most famous of defenses. I have no idea what any of this is. I had nothing to do with it.
Now, at the time, Parliament decided to appoint an independent panel to look into the allegations and give their consideration. The independent panel found that impeachment inquiries had to proceed. In other words, Parliament had to open an official investigation because there's enough smoke here to suggest that some kind of fire may actually exist. Parliament then under the full control of the ANC decided to bury the report. This was then referred to the constitutional court because a lot of members of parliament thought that this was definitely unconstitutional.
It took the constitutional court 521 days to finally render their judgment and judgment they did indeed render. Now what is important to note is that the concord did not find Ramapora guilty.
The Concord did not say that Ramapora must be impeached. Concord merely found that President Soraposa has enough to answer for that parliament acted unconstitutionally by burying the report and that Parliament now has to open an impeachment inquiry. In other words, parliament has to start investigating the matter. This suggests and definitely presents a number of challenges to solapa. The first of which is why did the concord now decide to uphold this ruling? Why did it take so long to actually render the judgment? This might be that Soraposa has become so unpopular with the levers of power within the ANC that the courts were finally allowed to render this judgment. It could also just be, you know, this is how it goes in Africa. Africa is always pretty slow.
Although I'm inclined to go with the first option. So what happens next?
Well, luckily I had the fortune of speaking to Ronaldo host uh as part of the truth report stuff and Ronaldo actually informed all of us in our group chat that uh the impeachment hearings will go as follows. Once impeachment is opened, it can take anywhere from 1 to 6 months. But impeachment carries with it significant downsides. If the president is found guilty and is impeached, he will immediately be forced to step down as president. He will also lose all of his benefits as president and he could even face criminal charges should it go that far. So fundamentally this is a serious issue. There have been reports and many people have actually suggested that Sorapa may just decide to resign as a result of this mainly because it would be kind of let's say reckless to go through and risk being impeached. The problem is that if you go down the list of all of the political parties that are now celebrating this, the EFF is celebrating this ruling and they have already written to parliament as you can see here to demand that parliament start these hearings as quickly as possible.
You have people like ATM who whose motion led to the National Assembly speaker establishing a 60 section 89 inquiry. They've called for the impeachment committee. Action SA has celebrated this saying they can't wait for the impeachment. The DA has come out and said that they will respect the constitutional court. And thanks to the fact that George Jordan Hill Lewis isn't in government, Jordan Lewis had a couple of choice things to say about this uh rendering about this judgment from the constitutional court. So, first, the DA's official statement says, "No one should expect the DA to shield wrongdoing. We will never be party to protecting misconduct, covering up corruption, or weakening accountability for political convenience. The impeachment committee must now do its work properly, rationally, fairly, and constitutionally. The president must have the opportunity to account fully."
Jordan E. Lewis on the other hand about an hour ago came out and said for too long and I quote, "The ANC has presided over a political culture in which accountability is delayed, diluted or avoided when it becomes inconvenient.
The DA stands for a different kind of politics in which the constitution comes before party loyalty and no leader is shielded from answering to the people.
This is a serious moment for parliament, for the presidency and for South Africa's constitutional democracy. The impeachment committee must now do its work properly, rationally, fairly, and constitutionally. All right. So, Jordy Lewis, good action essay, the EFF, the MK, they have all come out and they have all welcomed this. Why? Because Soraposa is an incredibly unpopular leader. A lot of members of the ANC themselves view Sora Ramapza as a significant threat to the party. MK and the EFF of course do not like Ramaposa and have never actually liked Ramaposa. And one could argue that should this actually go to impeachment, none of the ANC delegates are going to want to have to stand with him because this might open severe questions about their own conduct. This means that Sor Mapza is probably now for the first time standing alone. It's important to note that he canled all of his work trips. He was supposed to be in Suetto and decided not to go as he awaited the constitutional court's uh sort of rendering of their judgment. And I do actually expect that we might see might seem resign as president because that would safeguard everything, right?
He resigns, he wasn't impeached, he still gets all of his little benefits and he can go back to just being an ordinary citizen and an ex-president of South Africa. I would love to hear what you guys think is going to happen next.
