Local governments may lack the legal authority to enforce international criminal court arrest warrants, even when they express support for international law, as demonstrated by New York City Mayor Zohran Mamdani's inability to arrest Israeli Prime Minister Benjamin Netanyahu despite his campaign promise to do so.

'HYPOCRISY': Blue city leader TORCHED for push to arrest Netanyahu
Added:As mayor, New York City would arrest Benjamin Netanyahu. This is a city that our values are in line with international law. It's time that our actions are also.
>> Even though the US is not a signatory to the ICC.
>> No, it's time that we actually step up and make clear what we are willing to do to showcase the leadership that is sorely missing in the federal administration.
>> My administration has reviewed every avenue available under applicable law to determine whether New York City could execute the International Criminal Court's arrest warrant if Benjamin Netanyahu came here.
It is clear that we do not have the independent legal authority to enforce this warrant.
>> Well, that's New York City's mayor Zohran Mamdani having to backtrack on his campaign promise of executing an arrest warrant for Israeli Prime Minister Benjamin Netanyahu after the realization that his government has no authority to do so. Many told him that when he made the promise. And the mayor has long accused Netanyahu of genocide in Gaza, a charge that Israel rejects.
Mamdani is doubling down demanding the federal government arrest the Prime Minister on war crimes following a 2024 warrant issued by the International Criminal Court. Here's the problem. The US does not recognize the ICC and when pressured on the issue earlier today, the mayor reaffirmed his stance.
>> In the video, I made very clear as I have before that my interest in executing that warrant is not specific to Benjamin Netanyahu but to anyone who they put a warrant towards for war crimes and crimes against humanity.
>> Mamdani has long alienated the Jewish community with his criticism of the Israeli government. This comes as anti-Semitic incidents in New York State rose almost 500% in the last decade.
Mamdani's New York City accounts for almost 75% of New York's anti-Semitic assaults, harassment and vandalism.
A Jewish human rights organization is sounding the alarm on Mamdani saying that this is no longer about Netanyahu.
An excerpt reads this way, at a time when Jewish New Yorkers are experiencing alarming levels of anti-Semitism, harassment, and intimidation, they deserve a mayor who refrains from fomenting hatred against the world's only Jewish country while maintaining the fiction that this is not anti-Jewish.
The same day, Bowman doubled down on Netanyahu. He called out the entire Democratic Party. Bowman stoked the flames of division within the party while speaking with Rolling Stone magazine.
>> What is the Democratic Party if not its voters? And if you look at what Democrats are voting for in New York 13, in New York 7, in New York 10, and you say that that is not representative of the party, it may not be representative of what has effectively become our party, which is something that's run by well-paid consultants and big money interests, but it is representative of what Democrats themselves want to see.
>> Well, it's as if it was meant to be because precisely a few moments ago the Wall Street Journal published Paul Morrow's piece on this very matter, Bowman's foiled plot to kidnap Netanyahu. If he so much as tried, he might have found himself facing federal felony charges.
>> Yeah, so the gist of it now he's backed off, but the gist of it was that were he to order the NYPD to go out and arrest arrest Netanyahu knowing that he has no authority to do so. And in fact, if anybody took an overt step towards doing a substantial step, an overt act, you would have a conspiracy to commit kidnapping because there's no legal basis to do it. He knows that, and so he's knowingly conspiring with somebody else to say, go grab somebody illegally and let's recognize something else. He would be First of all, there's a statute right on point that says relative to heads of state that have come here, you can't do this. But furthermore, he has stated, well, this he should be tried in The Hague. So, under his theory of what he would do here as he was doing this performative nonsense that he has to know is not going to fly, he's going to kidnap Netanyahu and then put him on a plane and send him to The Hague to be prosecuted. There's no universe wherein that's going to fly. He knew it. It's all performative and I think the tell here is that he knows there's no federal case either. There's no federal standing to do what he's advocating, yet he's doubling down saying, "Well, we can't do it. I checked it out, but the feds should do it." He knows that that's not going to happen and can't happen either.
He's continuing to lie. It's all performative. He's playing to his base.
And I've got to say if he's so obsessed with Gaza and his base is so obsessed with Gaza, what are they doing to make Gaza better? Has he gone there? Has he done anything relative to the actual issue? Done nothing but grandstand. It's all performative. Let's just hope this DSA stuff comes and goes cuz it's nothing but a drag on the American experience.
>> And accountability Absolutely.
Accountability matters. I think it matters what you say on the campaign trail and if when you mislead your voters, and that's what he did. Listen to Martha MacCallum when she challenged him when he was running for office suggesting he couldn't do this. Listen.
You would arrest him if he came here if you were mayor?
>> I've said that this is a city that believes in international law and this is a city that wants to uplift and uphold those beliefs.
>> What grounds in the United States could you arrest him on?
>> As it has for Vladimir Putin. I've said that I believe that we should uphold arrest warrants by the International Criminal Court and that we would do should do so only in abiding with all of the laws in front of us. I'm not going to make a new law to ensure that we can actually do this.
>> So, we pushed on this and a number of other promises Harris and I I wonder if his supporters feel misled.
>> Well, he says he's not going to make a new law.
That's not breaking news. Of course he's not going to make a new law to be able to to arrest Netanyahu. He can't. Um look, this is stunty. It's exactly what you said, but this is what socialists do when their policies don't work. They have to create some sort of something that that talks to their base and says look, I'm doing something for you. I'm working in the same hate lane that you are. Let's all hate Jews together. We're in it together. By the way, you don't get all that free stuff I I promised.
You don't get those policies that actually deliver. It's Oh, and by the way, let's also hate rich people until they leave. I mean, this is stunted, but it's also bad. It's bad for the city.
>> Yeah, and Mike Huckabee made no two ways about it. Of course, ambassador to Israel would be easy to say New York mayor is just an ignorant bigot, but he is not dumb. He's an evil anti-semite who deliberately lies about serious things like genocide. And then he went on, Emily.
>> Yeah, he's an anti-semitic conniving communist. Look, since the three of us especially since we have to live in this anal gland, I want to point out a hypocrisy that this mayor is trafficking in that's a very insidious. So, recall when he issued an executive order here to ignore warrants issued under ISIS directive. He said it was a quasi legal, you know, extrajudicial process that had no application here in the city of New York. What do you call the International Criminal Court?
But somehow a warrant issued by them, he said with such grave consequences that he has to take seriously. But he refused to take seriously all of the warrants issued by judges having to do with illegal immigrants in the city that resulted in additional deaths and rapes.
For example, the guy after raping someone at La Quinta, after he was locked up at Rikers for 5 minutes, then ICE issued a detainer warrant for him. A judge issued another warrant, but what happens under Mumdani's watch? He goes free and he rapes another woman on Coney Island while his accomplice beats with a pipe her boyfriend who tried to intervene. Or the 19-year-old illegal immigrant that while ignoring getting to ignore the warrant murdered a 28-year-old. The list goes on. This show isn't long enough for me to list the warrants ignored under Mumdani's watch here Flying in the face of New Yorker's safety here for his joke of a stunt about Netanyahu that all it does is furthers the fact that he is anti-Semitic, anti-Zionist, anti-Israel, anti-Italian, and everything else under the sun.
>> Kennedy.
>> His wife is also pretty racist if you look at some of the tweets that she has favorited in the past. Uh it's interesting because he wants to arrest Netanyahu but somehow I have the feeling that if he could he would give Nicolas Maduro the key to the city. That Venezuelan socialist who is in a Manhattan jail.
>> Yes, that's right. What a juxtaposition of course one that we will follow. Well >> Hey everyone, I'm Emily Compagno.
