42000 ICE Arrests in June, New Deportation Court, and More

[00:00:25]My name is Alina Shautsova. Tonight we're going to have our live dedicated to the most recent interesting immigration news. We will be discussing increased arrests. Who is getting arrested? By who you're getting arrested? And why?

[00:00:42]42,000 arrests in June of this year.

[00:00:49]We're going to talk about secret court, new secret, some people labeling it as secret removal court that Trump administration activated for the first time in almost 30 years. And of course I will answer some of you guys' questions.

[00:01:33]We're going to start tonight with a very important announcement.

[00:01:39]Some of you believe that because ICE activity has not been widely reported recently in media, it means that ICE is dormant. They're not doing anything. Well, it's far from the truth.

[00:01:54]The truth is that ICE is very active.

[00:01:57]And in fact, according to the Guardian, 42,000, about 42,000 people were arrested by ICE only in June. And if you recall, in July, the numbers were even higher.

[00:02:11]Because 42,000 would put us about um 1,000 and a half.

[00:02:17]You know, 1,500 people per day, I would say.

[00:02:21]And in July, ICE reported they were arresting 3,000 people per day.

[00:02:27]And I can confirm that ICE reached even Long Island. Long Island, like Suffolk, Nassau, ICE is here, guys.

[00:02:38]So, what's happening? Where do they get all these people to arrest?

[00:02:43]Well, number one, multiple sources, of course, but number one, people with removal orders.

[00:02:49]People with removal orders are being actively searched by ICE. Removal, please contact your attorney immediately, okay?

[00:02:59]Some people have orders of removal in the United States. They were removed on paper. Their removal order is final.

[00:03:06]It's not on appeal. But uh they're still here in the United States. Sometimes they're working on their case, sometimes not. But if you are in this situation with a removal order, contact your lawyer immediately.

[00:03:20]ICE increased activities in airports.

[00:03:23]They are arresting even people who are simply waiting for their asylum interviews. Not everyone. We're not even sure how they choose people who they're arresting, but it's a fact. Other lawyers confirm that.

[00:03:39]And you need to know about this. So, unless you have a green card, valid non-immigrant status, or citizenship, try to stay away even from domestic travel. Very important.

[00:03:53]Another source reported that ICE arrests guardians who come to pick up immigrant children in shelters.

[00:04:03]They are non-accompanied minors and if they are if they are, let me see, guys, if they are connected to um I'm not sure why you guys say there's no volume. Let me see. Let me see if you have volume right now.

[00:04:25]Um if they are um being picked up by people who don't have status in the United States, then what happens is that those people are getting arrested. It's a terrible situation because imagine you have a little kid, right? A little kid who is in uh ICE custody.

[00:04:50]And you want that child, if you're a family member, even if you were just an uncle, you want that child to be at home with you. Maybe you are a parent.

[00:04:59]You may not have papers. Maybe you're working towards your status. Now, you have faced a choice. Pick up that kid or um you know, risk of being picked up yourself. It's it's it's a complete disaster, I have to say.

[00:05:18]Finally, despite the court order in New York, interestingly enough, ICE continues arresting people in courthouses. Can you believe that?

[00:05:30]So, this is something else that's going on right now and uh I think that whoever brought that lawsuit is going to be going for an emergency application before federal judge trying to correct this situation. But, it's a fact that ICE continues to arrest people in New York courthouses despite federal judge ordering to stop that.

[00:06:31]All right. So, we have next news that I wanted to discuss, and this is very interesting.

[00:06:39]So, um you probably were watching, you were following, or maybe you've heard that in 2025, as soon as Trump administration took over the office, they started arresting students, certain activists who were anti-Israel actions in Gaza.

[00:07:00]And they not just arrested those people, they wanted to deport them, and in some cases, they did secure orders of deportation from immigration court, like in the case of Mahmoud Khalil.

[00:07:14]But then there was another guy here.

[00:07:18]And if you're watching me on YouTube, you see um Al Jazeera screenshot reporting on the story of one pro uh um against Israel against activist. He's a green card holder.

[00:07:35]He was arrested in New York, and then New York federal court judge ordered him to be released. and the government appealed.

[00:07:44]The government appealed to the second federal circuit court that oversees New York federal courts.

[00:07:53]And the second federal circuit court stated that the release by a federal judge, rather than an immigration judge, was inappropriate.

[00:08:07]It's a very interesting situation, I have to tell you. Cuz the same very issue was sort of sorted by um federal courts and immigration courts in the case of Mahmoud Khalil. And here, it seems the case took a different turn.

[00:08:23]It's extremely important to understand that. All right?

[00:08:27]The case is about your rights as a green card holder, rights related to the first amendment, freedom of speech.

[00:08:39]But, you're also an immigrant. You don't have full rights like a US citizen.

[00:08:45]And the government uses this situation saying, "You know what?

[00:08:50]If you are just a green card holder, and you are saying something that we don't like this time." Cuz Biden administration did not care.

[00:09:01]Right? We do not like it this time. We can state that you are undesirable in the United States. And the question is this, can they do that?

[00:09:11]Just because of your speech, or they can't?

[00:09:14]And it's a very interesting topic, because it has been sort of vetted by the United States federal courts for decades. I would say even for a century.

[00:09:23]And different courts ruled different things.

[00:09:27]And now, what they're trying to do is they're trying to sort of say that we don't want to interfere anymore. Let an immigration court decide. But here is a huge difference that everybody needs to know.

[00:09:41]Immigration judges are not independent.

[00:09:47]They are under Attorney General. What Attorney General says, that's what they do. If they don't do what the Attorney General says, they get fired. Okay? They get fired.

[00:09:58]Federal court judges are independent.

[00:10:03]If you have an Article 3, I believe, that's what it's called, federal court judge, that judge is appointed for life.

[00:10:11]And that ensures such a judge's independence and their independent reasoning when they're making decisions. It's very important.

[00:10:22]But, it's a different story, completely different story for immigration court.

[00:10:26]So, by this ruling, I was actually very disappointed to see it, not for the substance, but for the reasoning that Second Circuit provided.

[00:10:36]By that ruling, basically, Second Circuit says that all these issues should be decided by immigration judges and we know what they will decide before you even going to step foot in their courtroom, right?

[00:10:51]An important decision, if you're a green card holder, just not telling you what to say or not to say. Keep this in mind.

[00:10:58]All right, keep this in mind.

[00:11:32]Hi Shaker, why is silent based I-45 taking so long? It's been 17 months I filed I-45, still waiting. Hi Shaker Khan, well, it doesn't really take that long.

[00:11:43]Um there used to be times in the United States because I've been practicing for 20 years when the such an such an application would take even longer, but this year what happened were the bans. Various bans that Trump administration installed against citizens, nationals, former nationals of various countries, and um that caused enormous delays. In addition, if you recall, in November of 2025, there was a general ban for all asylum seekers to receive green cards. So, it's basically because of the politics.

[00:12:34]Hi Navidas, what is the right time to apply for citizenship?

[00:12:39]All right. The right time will be when you satisfied all the requirements, you know you can prove good moral character, you don't have any issues such as arrests, um unpaid taxes, unpaid child support, consult with an attorney prior to filing, and that would be the right time to file for citizenship, okay?

[00:13:04]But if you do have any of the issues I mentioned, don't file for citizenship, consult with your lawyer first.

[00:13:14]Hi Doggy Trophy, could I ask what's the best way to green card for F1 graduate in this climate?

[00:13:21]Only EB routes. EB2, EB2 National Interest Waiver, EB1, depending on your qualifications.

[00:13:30]Uh EB routes should be great. If possible, file for adjustment of status.

[00:13:35]Again, due to bans, you may not be able to exercise consul route option.

[00:13:43]Hi Yume. Next week last the hearing, we changed our address first.

[00:13:49]Uh I guess 1 year ago, but we can't change our driver's license.

[00:13:54]Hi Yume. Why can't you file to change your driver's license?

[00:13:59]If you don't have updated driver's license address, why don't you show, if that would be requirement, uh some other proof of your new address, like a copy of your lease, for example.

[00:14:13]Okay?

[00:14:14]But uh just because you change your address, guys, in immigration court, it does not mean that the immigration court, on their own, automatically is going to transfer your case to a new jurisdiction.

[00:14:27]You will have to file a motion to change venue. And unless such a motion is granted, you must appear for your court hearing in your old jurisdiction.

[00:14:37]Tons of deportation orders are being issued because people think they don't have to appear in less convenient now state. So, don't make this mistake. Okay?

[00:14:49]Hi lawyer. Do you think the current duration of the stay rule is going to be challenged? Yes, I do believe so. I do believe it will be challenged, but it will be difficult to actually overcome it completely. Why? Because if you recall the last time Trump administration tried to change the rule, but they didn't go the right way about this. So, now they changed. If you look at the proposed rule and explanation that comes with it, it is 500 pages.

[00:15:24]Any lawyer who is going to be working on that lawsuit will have to spend considerable amount of time first just reading this 500 pages. You know, I I went through them quickly and lots of it is just some kind of a water, garbage really, but you have to read it. All right, you have to read it.

[00:15:45]Hi Solo Music, 75 countries update, no update really? So far, I'm not aware of any development, positive development here, okay?

[00:15:55]Hi Mad, is there any good news for I-751 about the processing time?

[00:16:02]No.

[00:16:04]Oh, unfortunately, same very lengthy processing times.

[00:16:08]And I wouldn't be rushing it, I'll be honest.

[00:16:12]US citizen parent sponsor adult unmarried children, priority date 2018 case and let's see how long again for a green card.

[00:16:22]If your priority date is 2018, when did you guys file the case? You filed it in 2018?

[00:16:30]So, you need to look at the visibility.

[00:16:32]I don't have it in front of me, but you have to choose the correct category and see filing dates, filing for filing chart, right? And that's when you know when you can file for adjustment of status if Department of State for August allowed to use that chart.

[00:16:55]All right? You have to read the little note um about the visibility because there are months when they say you have to use final dates for final actions and there are months when they say you can use dates for filing.

[00:17:15]All right?

[00:17:17]So, that's what it is. But, there is a catch to that. If your adult unmarried child, son, daughter, is in the United States, they only will be able to file for a green card here if they can show that they maintained lawful non-immigrant status throughout their stay in the United States. That's challenging to do for most people.

[00:17:44]Usually, they would have to show they they've been on the F1 green card or H1B with multiple extensions, okay?

[00:17:55]That's what usually happens. Again, do not know if that's going to happen in your uh case.

[00:18:01]All right, guys. Let me answer one more question. Is there a petition other petitions that have been reinstated after 7 years from Wait, wait.

[00:18:11]Destroyed by NBC section 203G. I don't know, guys. I don't think so. You have 1 year usually to reinstate. I've never heard of a case that would be reinstated after 7 years. It's just too long. They do give you 1 year of grace period, but then that's it, typically. Again, maybe you have a unique situation. Maybe there is something else going on. I do not know. But, uh they give you 1 year typically to file for a reinstatement once you stop talking to them. So, don't stop talking to them, okay?

[00:18:45]It's very important.

[00:18:48]All right?

[00:18:53]But, what you Yeah, and if the petition means uh was terminated was also what is also not good in that situation is that you cannot ask to transfer to recapture priority date.

[00:19:08]Okay?

[00:19:09]Cuz you need to you that even for family-based petitions, it is possible to capture recapture priority date in certain situation? Okay?

[00:19:21]All right. One more question, guys.

[00:19:27]Can I leave the country if I have a final deportation order?

[00:19:31]Hi, Alunov S. Well, you're supposed to leave the country if you have a final deportation order.

[00:19:38]But prior to doing so, why don't you consult with an attorney to make sure there are absolutely no options for you in terms of reopening your case or filing for a U visa or a T visa, something that would allow you to get status in the United States regardless of the final order of removal. It's very important. U visa and T visa do just that, okay?

[00:20:08]In terms of reopening, you also need to know I will again remind you guys, there is still an opportunity for some of you to reopen old order of removal if you're married to a US citizen, if you are residing in a group of states that the United States calls New England. Special settlement still in place until January 2027, okay? Special settlement authorized by a federal court. It seems almost like it's a unicorn, right? Because we know this administration does not want to negotiate and give any, you know, slacks to anybody.

[00:20:50]But this is a very interesting thing that still is a real opportunity for you guys to reopen your old orders of removal.
