🚨 JUNE 12 USCIS MEMO UPDATE: This is Worse Than We Expected

[00:00:00]All right, guys. So, I do have some bad news about the new policy memo. A couple applications for adjustment of status have been denied pursuant to this memo in the past few days. Honestly, the last like 72 hours. And you can find these examples on the USCIS subreddit. Um it's really concerning. I mean, some people have even posted copies of the denial decisions. And, you know, the two that I read recently and shared with my network. And by the way, everyone was like blown away. Some people were like, well, these could be the good cases that we use to file the circuit court lawsuits challenging this policy because you need a plaintiff for these lawsuits.

[00:00:39]So, someone has to actually be negatively impacted by the policy before you can file a lawsuit. So, there might be some lawsuits coming now that USCIS has actually applied the policy. In these decisions, people had overstayed.

[00:00:53]And basically, USCIS said, like, I see that you overstayed and then worked without authorization. And I see you have a bunch of positive equities. You have a US citizen spouse. You've never been convicted of a crime. You've done all this good stuff. And by the way, they had lawyers. At least two of them did. And they still denied it as a matter of discretion citing that adjustment of status is an extraordinary form of relief. So, this is actually quite concerning. This is the nightmare scenario that we've all been worried about. The two offices that I've seen this happen in, based on these posts and confirmation from some attorneys, is Fairfax and Hartford, Connecticut. Also, an attorney recently noted that they went to an adjustment of status interview in Tampa, Florida. And the officer straight up said, we've received guidance from our off um the head supervisor in this office to deny all adjustment of status applications. Or, in the alternative, if we don't want to deny, to pause it and not make a decision on it yet, waiting awaiting further guidance from headquarters. So, if you have an interview coming up in one of these locations, it's going to be super important to make your application as strong as possible with as many positive equities as possible. You know, if there is a way for you to reschedule, you might want to do that waiting for further guidance because things are getting really rough in a couple USCIS field offices. On the flip side, other field offices, like the ones in New York, recently I had interviews in Albany, New York City, USCIS officers are not even applying this memo. They're making no mention of it. They're not asking for any positive equities. If you try to submit evidence of positive equities, they're like, "No, no. We don't need any of that. We're not applying the memo right now." Everyone who's attended interviews in these offices in New York have reported like it was actually quite a pleasant and easy interview. They didn't make any mention of the fact that I overstayed my visa or anything like that. Other attorneys are reporting that for other USCIS field offices, but there are a handful of offices, like I mentioned last week in a video, San Bernardino, California. And you know, these California offices are sweet and dear to Stephen Miller. So, I'm not surprised that they're targeting people super hard in these offices. Um in those offices, they are asking people why they are adjusting status instead of consular processing as I've reported before. Anyway, guys, just wanted to make a quick unedited video. Just in the past 72 hours this has started happening. Everyone hasn't even caught wind of the fact that this has started happening unless you're obsessively checking Reddit.
